My SSDI Practice

To receive benefits under the Social Security Disability Insurance program, you must file a claim through the Social Security Administration, an arduous administrative process that can take months or years. More than half of all initial claims are denied and many are denied on appeal. Statistics show, however, that your chances of success increase when you are represented by an experienced SSDI attorney.

The SSDI process often involves three steps:

  • First, you must file an application for benefits, along with medical evidence to support your claim. If your application is approved, you will start receiving benefits immediately.
  • If your initial claim is denied (as most are), you will receive a letter notifying you of the denial. You can then file an appeal requesting a reconsideration. You may also submit additional medical evidence.
  • If your request for reconsideration is denied, you have the right to request a hearing with an administrative law judge. You may also present additional medical evidence at this stage of the process.

If your Social Security disability claim is denied by the administrative law judge, you can appeal to the Social Security Appeals Council in Washington, D.C. If that request for review is denied, you can file a civil action in Federal District Court challenging Social Security's denial.
